Welcome to Nazarpay.pk. These Terms of Service ("Terms") govern your use of our website and escrow services. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our services, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services. These Terms constitute a legally binding agreement between you and Nazarpay.pk.

2. Description of Services

Nazarpay.pk provides an escrow service that facilitates transactions between buyers and sellers in Pakistan. We act as a trusted third party that holds payment until all terms of an agreement are met. Our platform is designed to provide a secure environment for online transactions, reducing the risk of fraud for both parties.

Our services include but are not limited to payment processing, transaction verification, dispute resolution, and secure communication channels between transaction participants.

3. User Accounts

To use our services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to update your information as necessary to keep it accurate and current. We reserve the right to suspend or terminate accounts that contain false or outdated information.

You must be at least 18 years old to create an account and use our services. By creating an account, you represent and warrant that you are at least 18 years old.

4. Escrow Process

Our escrow process generally follows these steps:

1. Buyer and seller agree on terms
2. Buyer creates an escrow transaction
3. Buyer sends payment to Nazarpay.pk
4. Nazarpay.pk verifies the payment
5. Seller delivers goods or services to the buyer
6. Buyer inspects and approves the goods or services
7. Nazarpay.pk releases payment to the seller

Both parties are responsible for clearly communicating the terms of their transaction. Nazarpay.pk is not responsible for misunderstandings between transaction participants regarding the terms of their agreement.

5. Fees

We charge fees for our escrow services based on the transaction amount. Fees are displayed before you confirm a transaction. All fees are non-refundable unless required by law.

For subscription-based plans, fees are charged at the beginning of each billing cycle. You may cancel your subscription at any time, but no refunds will be provided for the current billing cycle.

We reserve the right to change our fee structure at any time. Any changes will be communicated to users in advance and will apply to transactions initiated after the effective date of the change.

6. User Conduct

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Engage in fraudulent activities
• Transmit harmful code or content
• Interfere with the operation of our services
• Engage in transactions involving prohibited items
• Impersonate any person or entity
• Harass, threaten, or intimidate other users
• Attempt to gain unauthorized access to our systems or other users' accounts

NAZARPAY.PK IS NOT RESPONSIBLE FOR ANYTHING THAT GOES AGAINST THE LAW AS WE DON'T KNOW WHAT YOU'RE SELLING OR BUYING. ALL USERS MUST RESPECT PAKISTANI LAW. IF WE DISCOVER ANY ILLEGAL ACTIVITY, WE WILL SUSPEND YOU FROM USING THIS PLATFORM FOREVER.

7. Prohibited Items

Our escrow service may not be used for transactions involving:

• Illegal goods or services
• Weapons or ammunition
• Drugs or controlled substances
• Counterfeit or stolen items
• Items that infringe on intellectual property rights
• Pornographic or obscene materials
• Human trafficking or prostitution
• Gambling or lottery services
• Financial pyramid schemes
• Any other items prohibited by Pakistani law

We reserve the right to refuse service for any transaction that we believe involves prohibited items or activities. We may report suspected illegal activities to appropriate authorities.

8. Security and Privacy

We implement industry-standard security measures to protect your personal and financial information. However, no method of transmission over the Internet or electronic storage is 100% secure.

Your security is our top priority. All transactions and personal data on Nazarpay.pk are protected with bank-level encryption and security protocols. We employ multiple layers of security to ensure your information remains 100% secure at all times.

9. Dispute Resolution

If a dispute arises between transaction participants, we will review the case and make a determination based on the evidence provided. Our decision is final and binding.

To initiate a dispute, you must contact our customer support within 14 days of the transaction completion date. Both parties will be given an opportunity to present evidence supporting their position.

We may request additional information or documentation to help resolve the dispute. Failure to provide requested information may result in a decision against the non-responsive party.

10. Limitation of Liability

To the maximum extent permitted by law, Nazarpay.pk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

Our total liability for any claim arising from or related to these Terms or our services shall not exceed the amount of fees paid by you to Nazarpay.pk during the six months preceding the claim.

We are not responsible for the quality, safety, legality, or delivery of goods or services exchanged through our platform. We simply facilitate the transaction between buyer and seller.

11. Indemnification

You agree to indemnify and hold harmless Nazarpay.pk and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of our services or violation of these Terms.

This includes legal fees and costs incurred by Nazarpay.pk in defending against such claims or enforcing these Terms.

12. Modifications to Terms

We may modify these Terms at any time. If we make material changes, we will provide notice through our website or by other means. Your continued use of our services after such notice constitutes your acceptance of the modified Terms.

It is your responsibility to review these Terms periodically to stay informed of any updates. If you do not agree with the modified Terms, you must stop using our services.

13. Termination

We may terminate or suspend your access to our services at any time, without prior notice, for any reason, including if you violate these Terms.

Upon termination, your right to use our services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Intellectual Property

All content, features, and functionality of our website, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Nazarpay.pk and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of Pakistan, and you consent to the personal jurisdiction of such courts.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and Nazarpay.pk regarding your use of our services and supersede all prior agreements and understandings.
